The difference this time is that they can adequately keep any hidden legendaries and/or Megas secret until they want us to know about them.

Depending on when Ash catches Sableye, it could just be 3 months before the X and Y saga begins. If it is indeed setting up a Sableye evolution, Ash's Unova team would be the last thing on the producers' minds. Aipom is a perfectly good comparison; a seemingly-superfluous old gen Pokemon caught...
What? No one's suggesting that Sableye gets caught in the movie. It's almost certainly getting caught before the movie. It's appearing as part of the gang on this poster.
If Sableye gets caught, which seems tremendously likely, I highly doubt it's going to anyone apart from Ash.
This has got the Aipom situation written all over it.
In fairness, it has been shown that there are multiple smashed cabinets at the P2 Laboratory in Episode N. It's consistent with anime canon, if nothing else.
The Mewtwo merchandise appears to be related to the anime, not this movie. As far as I'm aware, we haven't seen any shiny Genesect merchandise, either.
Also, we've had several pieces of anime-related merchandise with Genesect in them.
No smoking gun, but it's pretty damned likely, even putting aside the fact that, were Genesect not debuting before the movie, we probably wouldn't need the movie Genesect to be shiny at all.
Little, if any, of the initial trailer actually made it into the finished movie in anything like its original form, from a Dark Ash confrontation to the design of the city to the legendary beast reveals.
It's rare for the December trailer to be 100% accurate to the final movie. Ash in the initial Zoroark trailer is probably the biggest example.
