If you're playing Emerald, then you'll need to defeat Elite Four first. If you're play Ruby or Sapphire, then you can catch either Kyogre or Groudon (depending on the version you're playing) before Elite Four.

you can get rayquaza before the e4 in emerald, but ubers suck so yea
