yes you do have to be holding an item to use trick

before anyone says no try it your self against a foe you know holds an item like numel and use trick against it without holding an item then use it whilst holding one

oh and also straight from the main site

In a word, yes.
In a longer version: you have to be holding an item, but your opponent doesn't.
