I have emerald but do I have to defeat the elite4
to download pokemon from JAA?

I assume you would have to get the national pokedex to recieve a download.

To download YOU NEED A NATIONAL DEX!!! so yes that would mean beating the e4.

No, you do not need the National Pokedex. On Pokemon.com it says you need to be up to the point where you get the Pokedex. I saw some people at JAA that couldn't look up the Pokemon's Pokedex entry because they didn't have the National Dex.

Manene is right. You can get all of the downloadable pokemon as long as you have gone far enough in the game where you get the Pokedex from Professor Birch (in other words, about 10 minutes into the game). And you have to save at a Pokemon center. That's it. The download machines have some "override" to allow it.

I'm pretty sure you don't need to have the National Dex to download for JAA...one of my buds already went and he had only a couple badges in Emerald.
